This website and online store are operated by Talvior, 68 Kelloch Ave, San Francisco, California 94134, United States ("Talvior", "we", "us", "our").

These Terms of Service govern your use of our website and your purchase of products from us. Please read them carefully.

By placing an order with Talvior, you accept these Terms of Service. If you do not agree to them, please do not place an order.

Our products

Talvior sells home and kitchen products. We describe each product as accurately as we can, including its materials and dimensions. Colours may appear differently depending on your screen.

All prices are shown in US dollars and include no hidden charges. Shipping is free on every order, as set out in our Shipping Policy.

Orders and acceptance

When you place an order you will receive an order confirmation email. This confirms we have received your order; it does not guarantee acceptance. We may decline or cancel an order if the item is out of stock, if we identify a pricing or description error, or if we suspect fraud. If we cancel an order you have paid for, we refund you in full.

You may cancel your own order within 12 hours of placing it, as described in our Refund Policy.

Pricing and payment

Prices are those displayed on the product page at the time you order. We may change prices at any time, but a change never affects an order you have already placed. Payment is taken at checkout through Shopify's payment processor.

Your account and your content

If you create an account, you are responsible for keeping your password secure and for activity that takes place under your account. If you submit content to us, such as a product question or a message through our contact form, you confirm it is your own and that it is not unlawful, misleading or abusive.

Intellectual property rights

All content on this website — including text, product photographs, graphics, logos and the Talvior name — is owned by Talvior or used with permission, and is protected by intellectual property law. You may not copy, reproduce, republish or redistribute it for commercial purposes without our written consent.

Acceptable use

You agree not to use this website to break the law, to attempt to gain unauthorised access to our systems or data, to interfere with the operation of the site, to scrape or harvest data by automated means, or to place fraudulent orders.

Disclaimer of warranties

Our website is provided on an "as is" and "as available" basis. We do not warrant that the site will be uninterrupted or error-free.

This disclaimer applies to the website itself. It does not limit the 1-year warranty against manufacturing defects that we provide on our products, and it does not affect your statutory rights as a consumer.

Limitation of liability

To the fullest extent permitted by law, Talvior is not liable for indirect, incidental or consequential losses arising from your use of this website. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Your statutory rights as a consumer are not affected.

Indemnification

You agree to indemnify Talvior against claims and costs arising from your breach of these Terms or your misuse of this website.

Termination

We may suspend or terminate your access to this website, or refuse to accept future orders from you, if you breach these Terms, if you use the site unlawfully, or if we reasonably suspect fraudulent activity on your account.

Where practical, we will give you notice by email before doing so, and we will explain the reason. Termination does not affect orders you have already placed and paid for: those orders will still be fulfilled, or refunded in full, and your rights under our Refund Policy continue to apply to them.

You may stop using the website at any time. If you have an account, you may ask us to close it by emailing Talvior@outlook.com.

Sections that by their nature should survive termination — including intellectual property rights, limitation of liability, indemnification and governing law — continue to apply after termination.

Changes to these Terms

We may update these Terms of Service from time to time.

When we do, we will post the revised Terms on this page and update the "Last updated" date at the top, so you can always see when they last changed. If the change materially affects your rights or obligations, we will also notify you by email, at the address we hold for you, at least two weeks before the revised Terms take effect.

Changes never apply retroactively to an order you have already placed. The Terms that apply to your order are the ones in force on the day you placed it.

Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision is severed and the remaining provisions continue in full force.

Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign ours if our business is sold or reorganised, provided your rights are not reduced.

Entire agreement

These Terms, together with the Refund Policy, Shipping Policy and Privacy Policy linked above, form the entire agreement between you and Talvior.

Governing law and jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

You and Talvior agree that any dispute arising out of or relating to these Terms or to any order placed with us will be subject to the exclusive jurisdiction of the state and federal courts located in the State of California.
