Introduction

Talvior ("we", "us", "our") operates the online store at talvior.myshopify.com. This Privacy Policy explains what personal information we collect, how we collect it, why we use it, who we share it with, how long we keep it, and the rights you have over it.

By using our website or placing an order, you agree to the practices described in this policy.

Definitions and key terms

Personal data — any information that identifies you or could be used to identify you, such as your name, address, email address or payment details.
Usage data — information collected automatically about how you use our site, such as pages viewed and time spent.
Cookies — small text files stored on your device that let a website recognise your browser.
Data controller — the party that decides how and why personal data is processed. For this store, that is Talvior.

How we collect your information

We collect personal information in three ways:

Information you give us directly through forms. This includes our checkout form, our contact form, our newsletter signup form, and any email or phone call you send us. Through these you may provide your name, shipping address, billing address, email address and phone number.
Cookies. We and our service providers place cookies in your browser. These include strictly necessary cookies (which keep your shopping cart working and let you stay signed in), analytics cookies, and advertising cookies.
Tracking pixels and tags. Our pages load small tracking scripts and pixels, including the Google Analytics tag and the Google Ads conversion and remarketing tags. These record page views, referring URLs, device and browser type, approximate location derived from IP address, and actions such as adding an item to the cart or completing a purchase.

Information we collect

Personal data: name, shipping and billing address, email address, phone number, and order history.

Payment data: payment card details are collected and processed by Shopify's payment processor. We never see or store your full card number.

Usage data: IP address, browser type and version, device type, pages visited, time and date of visit, time spent on each page, and referring website.

How we use your information

To process, pack and deliver your order
To send you order confirmations, shipping confirmations and tracking information
To respond to your questions, returns and warranty claims
To detect and prevent fraudulent transactions
To meet our tax, accounting and other legal obligations
To measure how our website performs and improve it
To send marketing emails, where you have asked to receive them
To show you personalised advertising, as described below

Personalised and interest-based advertising

We use Google Ads and Google Analytics to measure our advertising and to show you interest-based advertising.

When you visit our site, the Google Ads remarketing tag and the Google Analytics tag may record which pages and products you viewed and whether you completed a purchase. Google may then use this information, combined with cookies and advertising identifiers in your browser, to show you Talvior advertisements on Google Search, YouTube, and websites in the Google Display Network. This is what is meant by personalised, or interest-based, advertising.

You can control this in three ways:

Turn off ad personalisation in your Google account at adssettings.google.com
Install the Google Analytics opt-out browser add-on at tools.google.com/dlpage/gaoptout
Reject non-essential cookies through the cookie banner on our site, or block or delete cookies in your browser settings

Opting out does not mean you stop seeing advertisements. It means the advertisements you see are no longer tailored to your browsing.

Cookies

We use strictly necessary cookies (required for the cart and checkout to function), analytics cookies (Google Analytics), and advertising cookies (Google Ads). You may refuse non-essential cookies through our cookie banner or your browser settings. Refusing strictly necessary cookies may stop parts of the store working.

Data sharing and disclosure

We do not sell your personal information. We share it only with:

Shopify, which hosts this store and processes payments
Our shipping carrier, which receives your name, address and phone number in order to deliver your parcel
Google (Google Analytics and Google Ads), as described above
Law enforcement or regulators, where we are legally required to disclose information, or where disclosure is necessary to protect our legal rights or prevent fraud
A successor entity, if Talvior is sold, merged or reorganised. We will notify you by email before your data becomes subject to a different privacy policy.

How long we keep your data

We keep order records for 7 years from the date of the order, because tax and accounting law requires us to.

We keep marketing contact details until you unsubscribe, and we delete them within 30 days of your unsubscribe request.

We keep contact form and support enquiries for 2 years from the date of your last message.

We keep analytics and advertising data for 26 months, which is the retention period configured in Google Analytics.

After these periods, data is deleted or irreversibly anonymised.

Your rights under the GDPR

If you are located in the European Economic Area or the United Kingdom, the General Data Protection Regulation (GDPR) gives you the following rights over your personal data:

Right of access — to obtain a copy of the personal data we hold about you
Right to rectification — to have inaccurate data corrected
Right to erasure — to have your data deleted, where we have no overriding legal obligation to keep it
Right to restrict processing — to limit how we use your data
Right to data portability — to receive your data in a machine-readable format
Right to object — to object to processing based on our legitimate interests, and to object to direct marketing at any time
Right to withdraw consent — where we rely on your consent, you may withdraw it at any time
Right to lodge a complaint — with your national data protection authority

Our legal bases for processing are: performance of a contract (to fulfil your order), legal obligation (tax and accounting records), consent (marketing emails and non-essential cookies), and legitimate interests (fraud prevention and improving our store).

Your rights under the CCPA (California residents)

If you are a resident of California, the California Consumer Privacy Act (CCPA), as amended by the CPRA, gives you the following rights:

Right to know — what categories of personal information we have collected about you, where it came from, why we collected it, and who we shared it with
Right to delete — to request deletion of the personal information we hold about you
Right to correct — to have inaccurate personal information corrected
Right to opt out of the sale or sharing of personal information — including the sharing of personal information for cross-context behavioural advertising
Right to limit use of sensitive personal information
Right to non-discrimination — we will not deny you goods, charge you a different price, or give you a lower quality of service because you exercised any of these rights

Your California opt-out right. Talvior does not sell your personal information for money. However, our use of Google Ads advertising cookies may count as "sharing" for cross-context behavioural advertising under the CCPA. To opt out of this sharing, use our Data Sharing Opt-Out page, reject non-essential cookies in our cookie banner, or email us at Talvior@outlook.com with the subject line "Do Not Sell or Share My Personal Information". We will action your request within 15 business days.

You may also use an authorised agent to submit a request on your behalf. We may ask for proof of their authorisation.

How to access, correct or delete your data

To exercise any right described above, follow these steps:

Email us at Talvior@outlook.com, or call +1 (701) 997-6768 during business hours.
Tell us which right you are exercising — access, correction, deletion, portability, restriction, objection, or opt-out.
Include the email address and, if applicable, the order number you used with us, so we can locate your records.
We acknowledge your request within 24 hours.
We may ask you to verify your identity, normally by confirming details of a recent order. This protects you from someone else requesting your data.
We complete your request within 30 days of verifying your identity, or within 45 days for CCPA requests. If we need longer, we will tell you why before that deadline passes.
If we cannot fully action your request — for example, because tax law requires us to retain an invoice — we will tell you exactly what we kept and the legal reason for keeping it.

There is no charge for making a request.

Marketing communications

We send marketing emails only to people who have asked to receive them. Every marketing email contains an unsubscribe link, and you may also unsubscribe by emailing Talvior@outlook.com. Unsubscribing does not stop transactional emails about orders you have already placed.

Children's privacy

Our store is not directed at children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, contact us at Talvior@outlook.com and we will delete it.

Data security

Our store is served over HTTPS, and payment data is handled by Shopify's PCI-compliant payment processor. No method of transmission over the internet is completely secure, but we take reasonable technical and organisational measures to protect your information.

Changes to this Privacy Policy

If we change this policy, we will post the updated version on this page and change the "Last updated" date at the top. If the change materially affects how we use your personal data, we will additionally notify you by email at the address we hold for you, at least two weeks before the change takes effect.
